Compatibilització de la prestació per atur amb l’inici d’una activitat per compte pròpia

En el Real Decret Llei 4/2013 es va aprovar pels menors de 30 anys el poder compatibilitzar l’atur amb l’inici d’una activitat per compte pròpia i gràcies a la Llei per al Foment del Treball Autònom i de l’Economia Social (publicada el 10 de setembre en el BOE, en vigor des del 10 d’octubre de 2015) s’ha fet extensiu a totes les edats.
– Qui podrà beneficar-se d’aquest incentiu?
Els treballadors desocupats que estiguin cobrant l’atur i causin alta com a treballadors per compte pròpia podran compatibilitzar la percepció mensual de l’atur amb el treball autònom.
– Durant quan de temps es podrà compatibilitzar?
El màxim s’estableix en 270 dies (9 mesos) o per un temps inferior en el cas que el sol·licitant disposi d’un temps inferior pendent de percebre.
– Quan s’haurà de sol·licitar?
Per poder beneficar-se d’aquest incentiu s’haurà de sol·licitar a la entitat gestora en el termini de 15 dies a comptar des de la data d’inici de l’activitat per compte pròpia. Passats 15 dies el treballador no podrà acollir-se a aquesta compatibilitat.
– Durant aquest període és obligatori que l’autònom renovi la demanda de la prestació, assisteixi a cursos de formació i altres obligacions establertes en el art. 231 de la Llei General de la Seguretat Social?
No. Durant el temps que duri la compatibilitat de la prestació amb el treball per compte propi, no se li demanarà al treballador que compleixi amb les obligacions com a demandant de feina i derivades del compromís de l’activitat indicades en el anterior article.
– Qui no podrà beneficar-se d’aquest incentiu?
Aquelles persones que el seu últim treball hagi estat per compte pròpia , i hagin fet ús d’aquest dret o obtingut el pagament únic de la prestació per atur en els 24 mesos immediatament anteriors.
Tampoc s’ho podran aplicar aquells que es donin d’alta com autònoms i signin un contracte per la realització de la seva activitat professional amb l’empresa on fins ara hi estaven treballant per compte d’altre.
I per últim, la realització d’un treball per compte d’altre a temps complet o parcial suposarà el fi de l’aplicació d’aquest incentiu.
